Terms of Service

Effective: 30 April 2026

These Terms of Service form a binding contract between you and Abaqwa SARL (“Abaqwa”). By creating an account or using any Abaqwa app you accept them in full. If you do not agree, do not use the service.

1. The service

Abaqwa connects passengers, parcels, and travellers with independent drivers, transporters, hoteliers, and errand runners. Abaqwa is a technology platform; the actual transport, delivery, accommodation, and errand services are provided by the third-party operator you book with.

2. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to register a customer account. Driver and merchant accounts have additional KYC requirements (identity document, vehicle papers, business registration as applicable).

3. Account security

You are responsible for keeping your phone number, password, PIN, and one-time codes confidential. Notify us immediately at support@abaqwa.com if you suspect unauthorised access; we will revoke active sessions on request.

4. Payments

Fares, parcel quotes, hotel rates, and commissions are shown before you confirm a booking. Payment is processed via your Abaqwa Wallet, mobile money, or card (powered by QuataPay). Refund eligibility is governed by the cancellation policy in effect at the time of booking; current terms are visible at checkout.

5. Conduct

You agree not to harass, defraud, or endanger any party using the platform; not to upload illegal or infringing content; not to scrape, decompile, or interfere with the service.

6. Driver / merchant terms

Drivers and merchants are independent contractors. By signing up you accept the platform-specific commission split, payout cadence, and conduct rules detailed in your driver / merchant agreement. The current commission percentages are visible at any time inside the operator dashboard.

7. Liability

Abaqwa’s liability for any claim arising from your use of the platform is limited to the total fees you paid in the ninety (90) days preceding the claim, except where unlimited liability is mandated by Cameroon law.

8. Termination

Either party may terminate at any time. You can request account deletion via /delete-account. We may suspend or terminate an account that violates these terms or endangers other users.

9. Governing law

These terms are governed by the laws of the Republic of Cameroon. Disputes that cannot be resolved by support are submitted to the courts of Yaoundé.
